This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Business, for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information.
  • CCPA and/or CPRA refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to VNDCK Consulting BV, Overes 95, 3990 Peer, Belgium, company number BE 0750.489.097. For the purpose of the GDPR, the Company is the Data Controller, except where this Privacy Policy says that it acts as a processor for an Organization.
  • Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident.
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website.
  • Country refers to: Belgium
  • Creator means a person who creates short-form videos and whose social media accounts are tracked in the Service.
  • Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • GDPR refers to EU General Data Protection Regulation.
  • Organization means a business that uses the Service, and the workspace in which its team works.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. For the purpose of the GDPR, Service Providers are considered Data Processors.
  • Third-party Social Media Service refers to TikTok, Instagram, YouTube, Facebook and any other social network whose public content the Service shows, or through which a User can log in.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the time of a sign-in).
  • Website refers to Shortalyze, accessible from https://shortalyze.com
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR, You can be referred to as the Data Subject or as the User as you are the individual using the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Company name, billing address and VAT number
  • The Organizations You belong to and Your role in them
  • Usage Data

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the time and date of Your sign-in, important actions in Your Organization (recorded in an audit log), and errors.

Information from Third-Party Social Media Services

Creators can sign in to their portal with their TikTok account. If You do, TikTok shares Your account identifier, username and display name with Us. We use these only to match You to an existing Creator profile and to secure Your access. We store Your TikTok identifier, username, display name and sign-in timestamps. Your password stays with TikTok. Access tokens are used to read Your profile during sign-in and are not stored. We do not request permission to publish videos or to read private messages.

Creators can also sign in with their YouTube channel through Google's authorization service. We request read-only YouTube access and use it only to read the identifiers, handles and names of the channels You own, to match an existing Creator profile. We store the channel identifier, handle, name and sign-in timestamps. We do not use Your Google email address to grant Creator access, and we do not read Your videos, playlists, subscriptions or private messages through this authorization. Access tokens are used only during sign-in and are not stored; we do not request offline access or permission to publish or change content. You can remove Google's authorization at https://myaccount.google.com/permissions. Contact Us to request deletion of Your stored sign-in information.

Shortalyze's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Creators can also sign in with a professional Instagram account (Business or Creator). We request only basic account access (instagram_business_basic) to verify the account identifier, username, display name and account type, and match an existing Creator profile tracked by a brand or agency. We store the account identifier, username, display name and sign-in timestamps. Your password stays with Instagram. Access tokens are used only during sign-in and are not stored or refreshed. We do not request access to messages, comments or insights, or permission to publish or change content. You can remove Shortalyze's authorization in Instagram's Apps and Websites settings. To delete the sign-in information already stored by Shortalyze, follow our data deletion instructions.

Creators can also sign in with a Facebook Page they manage and can create content on. We request pages_show_list to verify the Page identifier, public profile link, name and content creation access, and match a Facebook Page already assigned to a Creator by a brand or agency. Facebook's basic profile permission is part of its authorization flow, but Your personal Facebook name, email and profile do not grant Creator access. We store only the verified Page identifier, handle or identifier, Page name and sign-in timestamps. Access tokens are used during sign-in only, are not stored or refreshed, and are never used to publish, edit, read private messages or read Page posts or followers. Your password stays with Facebook. You can remove the authorization in Facebook's Business integrations settings and follow our data deletion instructions to delete stored sign-in information.

Shopify Order Analytics

When an Organization connects its Shopify store, Shortalyze reads order identifiers, discount codes, payment and refund transaction identifiers, amounts, currencies and processing dates to show that store's sales reports. We request read-only order access. We do not request customer names, email addresses, phone numbers, postal addresses or permission to change orders or issue refunds. We do not add tracking code to the storefront through this integration.

The Organization controls this order data and Shortalyze processes it on the Organization's behalf. Access and refresh tokens are stored encrypted. Imported data is accessible only within the connected Organization and is not sold, used for advertising or used to train AI models. We retain imported order data while the connection is active. Disconnecting removes the connection, tokens and imported orders from our application database. We also process Shopify's uninstall and deletion notifications. Keyed deletion markers prevent deleted orders from being imported again; these markers are removed when Shopify requests erasure of the store's data. Deleted data may remain in database backups until the backup retention cycle expires, currently seven days.

Shopify customer data requests are made available to the Organization's owners and administrators as an export under Integrations → Shopify so they can respond to the customer. We store the request number and encrypted order or customer identifiers used to locate the requested records, not the customer's contact details. Customer deletion requests remove matching imported records and identifiers held in outstanding requests. Customers should contact the merchant to exercise their rights, or contact support@shortalyze.com for assistance.

Public Profile and Video Information

The Service collects public information from Third-party Social Media Services by visiting public pages without signing in: public handles, display names, profile pictures, follower counts, video links, captions, thumbnails, upload times and public engagement counts (views, likes, comments, shares and saves). We do not collect private messages, private content or the identities of Your followers.

This information is collected for the Organizations that track a profile, either because they work with the Creator or for market research on public business and creator profiles. Information about a public profile may be collected once and shown to every Organization that tracks the same profile.

Tracking Technologies and Cookies

We use Cookies that are necessary for the Service and first-party analytics Cookies from PostHog. We do not use advertising Cookies and We do not track You across other websites.

  • Necessary / Essential Cookies. Type: Session and Persistent Cookies. Administered by: Us and Our identity provider Clerk. Purpose: these Cookies keep You signed in, protect the TikTok, YouTube, Instagram and Facebook sign-in against forgery (valid for 10 minutes) and remember which Organization You work in. The Creator portal session lasts up to 30 days.
  • Functionality Cookies. Type: Persistent Cookies. Administered by: Us. Purpose: these Cookies remember choices You make, such as the time zone in which statistics are shown and whether You hid the getting-started checklist.
  • Analytics Cookies. Type: Persistent Cookies. Administered by: PostHog on Our behalf. Purpose: these Cookies hold a random identifier and the current session, so We can see how the Service is used across visits and improve it.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service and keep it secure.
  • To manage Your Account: to manage Your registration as a user of the Service and Your membership of Organizations.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the Credits You have purchased or of any other contract with Us through the Service.
  • To measure Creator performance: to show Organizations the public performance of the Creators they work with, to calculate the fees and bonuses they agreed, and to show Creators their own videos and payouts.
  • To contact You: by email regarding invitations, Your Account, billing, and updates or informative communications related to the functionalities or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To manage Your requests: to attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, in which Personal Data held by Us about our Service users is among the assets transferred.

We do not use Personal Data for advertising and We do not sell it as a dataset.

We may share Your personal information in the following situations:

  • With Service Providers: to host the Service, to authenticate users, for payment processing, to send emails and to prepare payouts.
  • With Organizations: the Organization You belong to sees Your name, email address and role. An Organization that works with a Creator sees that Creator's videos, agreements and payouts. Public video statistics can be compared across Creators; private payout details are not shown to other Creators.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Our Role for Organization Data

For the data an Organization puts into the Service, such as the Creators it works with, their agreements and payouts, the Organization is the controller and the Company processes that data on its behalf. Questions about that data should go to the Organization first.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. In particular:

  • Account data is kept as long as You have an Account and deleted within 30 days after You delete it.
  • Organization data is kept for 90 days after an Organization is deleted, so it can be exported, and then deleted.
  • Creator sign-in information is kept while portal access is enabled and deleted after 24 months without a sign-in or on request.
  • Public profile and video information is kept while an Organization tracks the profile.
  • Security logs and the audit log are kept for up to 2 years.
  • Invoices and accounting data are kept for 7 years, as Belgian accounting law requires.
  • Backups are overwritten in their normal cycle.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. The Service and its database are hosted in the European Union (Microsoft Azure, West Europe). Some Service Providers process data outside the European Economic Area.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place, such as an adequacy decision (including the EU-US Data Privacy Framework) or the European Commission's Standard Contractual Clauses.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service. Owners can export and delete their Organization in its settings. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Object to the Collection of Your Public Profile

If Your public social media profile is tracked in the Service, You can object at any time. Write to support@shortalyze.com from an address We can link to the profile, or send a direct message from the profile itself, with the link to Your profile. We will stop collecting data about that profile, remove the shared profile information, add the profile to a block list so it cannot be added again, and inform the Organizations that tracked it. We aim to do this within 30 days.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. Data is encrypted in transit and at rest, Organizations are isolated from each other in the application and in the database, and integration keys are stored encrypted. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Detailed Information on the Processing of Your Personal Data

The Service Providers We use may have access to Your Personal Data. These third-party vendors collect, store, use, process and transfer information about Your activity on Our Service in accordance with their Privacy Policies.

Analytics

We use PostHog, a product-analytics platform hosted in the European Union, to understand how people use the Service so We can improve features and fix issues. Event data may include page views, clicks, feature usage, errors and recordings of sessions (input fields are masked). When You are signed in, events are associated with Your account ID, name and email address and with Your Organization; in the Creator portal, with Your Creator ID and social media handle. Their Privacy Policy can be viewed at https://posthog.com/privacy

An Organization can connect its own product analytics (PostHog) to compare app usage with video performance. That data belongs to the Organization and is exchanged with PostHog on its instruction.

Authentication

We use a third-party identity provider to manage user sign-up, sign-in, and session management.

  • Clerk. Clerk handles account creation, password storage (Clerk never shares passwords with Us in plaintext), social sign-in, multi-factor authentication, session tokens and Organization invitations. We receive only the public account information (such as Your email and name) needed to provision and identify Your Shortalyze account. Their Privacy Policy can be viewed at https://clerk.com/legal/privacy
  • TikTok. Creators sign in with TikTok as described above. Their Privacy Policy can be viewed at https://www.tiktok.com/legal/privacy-policy

Email

We use an email Service Provider to send service emails, such as invitations, billing messages and alerts about Your data. We do not send marketing emails.

  • Resend. Their Privacy Policy can be viewed at https://resend.com/legal/privacy-policy

Payments

We provide paid Credits within the Service and use third-party services for payment processing.

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

  • Stripe. Their Privacy Policy can be viewed at https://stripe.com/privacy

Creator Payouts

Organizations pay Creators through a payout provider they connect themselves. The Service creates payout requests in the Organization's provider account with the information needed for the payment (such as the Creator's name, email address and the amount).

  • Talentir. Their Privacy Policy can be viewed at https://www.talentir.com/privacy

Hosting and Infrastructure

We rely on third-party cloud-infrastructure providers to host the Service, store Your data, and process background jobs. These providers process Personal Data on Our behalf under data-processing agreements; they do not use Your data for their own purposes.

  • Microsoft Azure hosts the application, the database and Our secrets in the European Union (West Europe). Their Privacy Policy can be viewed at https://privacy.microsoft.com
  • To collect public information from Third-party Social Media Services, We route requests through a residential proxy provider. Only public page requests pass through it; no Account data does.

GDPR Privacy

Legal Basis for Processing Personal Data under GDPR

We may process Personal Data under the following conditions:

  • Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
  • Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof. This applies to Your Account, Organization membership, Creator sign-in and billing.
  • Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which the Company is subject, such as keeping invoices.
  • Legitimate interests: Processing Personal Data is necessary for the purposes of the legitimate interests pursued by the Company or by Organizations. This applies to keeping the Service secure, and to collecting public profile and video information to measure Creator performance, calculate agreed payments and research public business and creator profiles. You can object to this processing at any time.

In any case, the Company will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Your Rights under the GDPR

The Company undertakes to respect the confidentiality of Your Personal Data and to guarantee You can exercise Your rights.

You have the right under this Privacy Policy, and by law if You are within the EU, to:

  • Request access to Your Personal Data. The right to access, update or delete the information We have on You. Whenever made possible, you can access, update or request deletion of Your Personal Data directly within Your account settings section. If you are unable to perform these actions yourself, please contact Us to assist You. This also enables You to receive a copy of the Personal Data We hold about You.
  • Request correction of the Personal Data that We hold about You. You have the right to have any incomplete or inaccurate information We hold about You corrected.
  • Object to processing of Your Personal Data. This right exists where We are relying on a legitimate interest as the legal basis for Our processing and there is something about Your particular situation, which makes You want to object to our processing of Your Personal Data on this ground.
  • Request erasure of Your Personal Data. You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.
  • Request the transfer of Your Personal Data. We will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with You.
  • Withdraw Your consent. You have the right to withdraw Your consent on using your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service. Creators can also withdraw TikTok permissions in TikTok.

Exercising of Your GDPR Data Protection Rights

You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try our best to respond to You as soon as possible, and within 30 days.

You have the right to complain to a Data Protection Authority about Our collection and use of Your Personal Data. In Belgium, this is the Data Protection Authority (www.dataprotectionauthority.be). If You are elsewhere in the European Economic Area (EEA), you can also contact Your local data protection authority.

CCPA/CPRA Privacy Notice (California Privacy Rights)

This privacy notice section for California residents supplements the information contained in Our Privacy Policy and it applies solely to all visitors, users, and others who reside in the State of California.

Categories of Personal Information Collected

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Device. The following is a list of categories of personal information which we may collect or may have been collected from California residents within the last twelve (12) months.

  • Category A: Identifiers. Examples: a real name, alias, online identifier, Internet Protocol address, email address, account name. Collected: Yes.
  • Category B: Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). Examples: a name, address, and financial information such as payout amounts. Collected: Yes.
  • Category C: Protected classification characteristics under California or federal law. Collected: No.
  • Category D: Commercial information. Examples: records of Credits purchased. Collected: Yes.
  • Category E: Biometric information. Collected: No.
  • Category F: Internet or other similar network activity. Examples: interaction with our Service, and public social media activity of tracked Creators. Collected: Yes.
  • Category G: Geolocation data. Collected: No.
  • Category H: Sensory data. Collected: No.
  • Category I: Professional or employment-related information. Examples: agreements between Organizations and Creators, and the performance of Creators' public videos. Collected: Yes.
  • Category J: Non-public education information. Collected: No.
  • Category K: Inferences drawn from other personal information. Collected: No.
  • Category L: Sensitive personal information. Examples: account login information. Collected: Yes.

Under CCPA/CPRA, personal information does not include publicly available information from government records, deidentified or aggregated consumer information, and information excluded from the CCPA/CPRA's scope.

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from You. For example, from the forms You complete on our Service or from Your purchases on our Service.
  • From Your Organization. For example, when an Organization invites You or records an agreement with You.
  • From public sources. For example, public profiles and videos on Third-party Social Media Services.
  • Automatically from You. For example, through Cookies We set on Your Device as You navigate through our Service.
  • From Service Providers. For example, Our identity provider and payment processor.

Use of Personal Information

We may use or disclose personal information We collect for "business purposes" (as defined under the CCPA/CPRA), which may include the following examples:

  • To operate our Service and provide You with Our Service.
  • To provide You with support and to respond to Your inquiries, including to investigate and address Your concerns and monitor and improve our Service.
  • To fulfill or meet the reason You provided the information.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • For internal administrative and auditing purposes.
  • To detect security incidents and protect against malicious, deceptive, fraudulent or illegal activity, including, when necessary, to prosecute those responsible for such activities.

If We decide to collect additional categories of personal information or use the personal information We collected for materially different, unrelated, or incompatible purposes, We will update this Privacy Policy.

Disclosure of Personal Information

We may disclose and may have disclosed in the last twelve (12) months categories A, B, D, F and I for business purposes, to the Service Providers and Organizations described in this Privacy Policy. When We disclose personal information to a Service Provider, We enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Sale of Personal Information

We do not sell or share personal information, as those terms are defined in the CCPA/CPRA, and We have not done so in the last twelve (12) months. We do not use advertising or cross-context behavioral advertising.

We do not knowingly collect personal information from minors under the age of 16.

Your Rights under the CCPA/CPRA

If You are a resident of California, You have the following rights:

  • The right to notice. You have the right to be notified which categories of Personal Data are being collected and the purposes for which the Personal Data is being used.
  • The right to know/access. You have the right to request that We disclose information to You about Our collection, use and disclosure of personal information: the categories and specific pieces of personal information We collected about You, the categories of sources, Our business purposes, and the categories of third parties with whom We share it.
  • The right to correct Personal Data. You have the right to correct or rectify any inaccurate personal information about You that We collected.
  • The right to limit use and disclosure of sensitive Personal Data. We only use sensitive personal information as necessary to provide the Service.
  • The right to delete Personal Data. You have the right to request the deletion of Your Personal Data under certain circumstances, subject to certain exceptions, for example when retaining the information is necessary to complete a transaction, detect security incidents, or comply with a legal obligation.
  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of Your consumer's rights.

Exercising Your CCPA/CPRA Data Protection Rights

In order to exercise any of Your rights under the CCPA/CPRA, and if You are a California resident, You can contact Us by email at support@shortalyze.com.

Only You, or a person registered with the California Secretary of State that You authorize to act on Your behalf, may make a verifiable request related to Your personal information. Your request to Us must provide sufficient information that allows Us to reasonably verify You are the person about whom We collected personal information or an authorized representative, and describe Your request with sufficient detail that allows Us to properly understand, evaluate, and respond to it.

We will disclose and deliver the required information free of charge within 45 days of receiving Your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.

"Do Not Track" Policy as Required by California Online Privacy Protection Act (CalOPPA)

Our Service does not track You across third-party websites. Our first-party analytics (PostHog) does not respond to Do Not Track signals.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us, such as the social media videos it shows. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.
